The sale is listed and sold pursuant to the North Carolina Judicial Sales Act, N.C. Gen. Stat. Chapter 1, Article 29A. Once the initial offer is accepted by the Commissioner, a report of sale must be filed with the Clerk of Court pursuant to NC Gen. Stat. §1-339.35. That initial offer to purchase is subject to upset bid or bids that must be filed with the Clerk of Court pursuant to NC Gen. Stat. §1-339.36. After the report of sale has been filed with the Court and more than 10 days have passed without an upset bid then the Commissioner shall file a motion to confirm the sale pursuant to NC Gen.
